Trumping Home Rule and Sanctuary Jurisdictions
The issue of sanctuary jurisdictions is an important and timely topic. Both the federal government and many states have made this issue a priority and are pressuring local governments to change any so-called sanctuary policies. The first presenter will provide an overview of the legal landscape when it comes to federal inducements and pressures on states and local governments, including a discussion on the Spending Power, Commandeering and the Tenth Amendment. The second presenter will provide an in-depth analysis of the issue of ICE Detainer compliance. The third presenter will discuss the status of the federal litigation in City & County of San Francisco v. Trump and also provide an update on any pending federal legislation relevant to the topic, including the potential effect of H.R. 3003.
