Effective March 2017, ICE has begun using a new immigration detainer form—DHS Form I-247A. The new form is different from its predecessors in two ways: the new form will be accompanied by a warrant for arrest or a warrant for removal; and the new form removes a long list of check-boxes and replaces them just four check-boxes. Form I-247A will be reviewed through the lenses of the 4th and 10th Amendments, and the legal options available to County jails that receive the new immigration detainer form explored.
